Rollick operates as a marketplace facilitator, providing a platform for users to buy, sell, and trade merchandise. Rollick connects buyers and sellers but is not itself a party to marketplace transactions between users.
Under Section 230 of the Communications Decency Act (47 U.S.C. § 230), Rollick is not the publisher or speaker of user-generated listings. Content posted by sellers — including item descriptions, photographs, and pricing — reflects the views and representations of the individual seller, not Rollick.
Rollick's role is limited to:
Rollick does not take title to, possess, or inspect items listed by sellers, except items originally distributed through Rollick pack openings, which are verified authentic.
Despite Section 230 protections, Rollick voluntarily monitors listings for prohibited content, counterfeit goods, and policy violations. This voluntary monitoring does not create an obligation to review every listing or waive any applicable legal protections.
Under marketplace facilitator laws enacted in 45+ states, Rollick is responsible for collecting and remitting sales tax on marketplace transactions where Rollick facilitates the sale and processes payment.
For states where Rollick does not have marketplace facilitator obligations, sellers are responsible for their own tax compliance.
Sales tax does not apply in states with no sales tax (OR, DE, MT, NH) or on transactions between users in the same tax-exempt category.
Rollick processes marketplace payments through Stripe Connect, a licensed payment facilitator. Stripe Connect holds applicable money transmitter licenses on behalf of marketplace platforms.
Rollick does not directly hold, transmit, or control buyer funds — Stripe acts as the payment processor.
Transaction flow:
The 48-hour hold period is a standard payment facilitation practice, not a regulated escrow service.
Rollick does not pool user funds or commingle marketplace proceeds with operating funds.

Rollick has consulted with legal counsel regarding money transmitter licensing exemptions applicable to marketplace facilitators using licensed payment processors.
Rollick provides transaction security through Stripe Connect's built-in escrow functionality. Funds are held by Stripe (not Rollick) during the 48-hour buyer review period.
This structure is designed to fall within the "payment processor exemption" to state money transmitter laws.
Rollick does not charge a separate escrow fee — the service is included in the 5% marketplace fee.
Rollick complies with the FTC Act (Section 5) prohibition on unfair or deceptive trade practices.
Listing requirements:
Price manipulation, shill bidding, wash trading, and artificial demand creation are prohibited (see Seller Agreement Section 7).
Rollick maintains an internal compliance team that reviews flagged listings. Users can report suspicious listings via the report button on any listing page.
Rollick cooperates with the FTC and state attorneys general on consumer protection matters.
Rollick prohibits the listing of stolen, counterfeit, or misrepresented goods.
Items distributed through Rollick pack openings are guaranteed authentic — they are sourced directly from authorized distributors and verified before inclusion in packs.

Sellers must not list items that infringe on third-party intellectual property rights.
Brand owners may submit IP infringement claims through Rollick's DMCA process (see DMCA Policy).
Rollick participates in brand protection programs and will remove infringing listings upon valid notice.
Repeat IP infringers will lose marketplace access per Rollick's repeat infringer policy.
Rollick does not verify the authenticity of items listed by individual sellers — only items from Rollick pack openings are verified.
Rollick issues IRS Form 1099-K to sellers who exceed the federal reporting threshold ($600/year in gross sales).
Sellers are responsible for reporting all marketplace income regardless of whether a 1099-K is issued.
The following activities are strictly prohibited and will result in immediate suspension:
Buyer disputes must be filed within 48 hours of item receipt (see Dispute Resolution Policy).
Rollick's marketplace dispute team reviews all evidence from both parties.
Resolution options:
Rollick's dispute resolution decision is binding for marketplace transactions. Either party may appeal within 7 days.

Rollick is not a party to marketplace transactions between users.
Rollick does not guarantee the quality, safety, legality, or authenticity of user-listed items. Only Rollick-distributed pack items are guaranteed.
Rollick's liability for marketplace-related claims is limited to the marketplace fee collected on the disputed transaction.
Users agree to indemnify Rollick against claims arising from their marketplace activities.
